The Good Fight Season 5, Episode 3 recap: And the Court Had a Clerk…

The Good Fight Season 5 addresses the January 6th attack on the Capitol by strategically placing Diane (Christine Baranski) at its center. She wasn’t involved in any way, but of course, Kurt (Gary Cole) somehow finds himself connected to the mess.
Leave it to this series to consistently find a way to rope real-life events into their storylines. They always manage to do it in a way that’s witty, impactful, and, most importantly, enjoyable to watch. And this week is no exception.
Apart from the predicament that Diane and Kurt find themselves in, we get more of Judge Wackner (Mandy Patinkin) and Circuit 9 3/4 in this week’s episode. The hilarity continues with his antics in the “courtroom” with Marissa (Sarah Steel) continuing to help him out, despite Diane’s wishes.
And then we’ve got Carmen (Charmaine Bingwa), who is more and more elusive with every passing episode. Is she a heroine? Is she a villain? What are her intentions? This week doesn’t really help us understand what she’s up to, but I will say I am very intrigued.

The Good Fight Season 5, Episode 3 recap: Kurt and Diane
As fate would have it, Kurt somehow finds himself smack dab in the middle of the Capitol riot aftermath. It’s by sheer accident, of course, but he ends up training the insurrectionists and setting up a Capitol tour for them on January 5.
Kurt being targeted ends up being Diane’s fault because she’s the one who tips off the Feds. That is before she learns that Kurt was training veterans with PTSD who ended up attacking the Capitol. Kurt’s name is all over this, and even though he wasn’t involved, Agent Starkey (Jane Lynch) will not let this one go easily.
Ironically, Diane got Kurt into this mess, and now she has to be the one to get him out. I’m not sure how this is going to impact their marriage, but it certainly can’t do wonders. They’ve already dealt with infidelity, and now they’ve got this. If Kurt ends up in jail, it could be game over for this power duo.
What makes matters worse is that Kurt refuses to turn in Dylan Pike, one of the insurrectionists. Instead of following Kurt’s wishes, Diane turns in Dylan, once again putting something else before her marriage. Oh, Diane.
The Good Fight Season 5, Episode 3 recap: Circuit 9 3/4
Meanwhile, Judge Wackner and his “court” provide all the laughs from this week’s episode. It’s exactly what we needed to counteract all the heaviness from Diane and Kurt’s storyline. In an attempt to fix the system, Wackner continues to handle court cases in the way he sees fit. That means applying his own logic and rules to make decisions. It’s pretty awesome, as ridiculous as it may seem.
It seems like Wackner has grown fond of Marissa, so much so that he asks her to be his law clerk. He doesn’t seem to care that she’s not even a real lawyer yet, but he’s not one to follow the rules anyhow. I’d say it’s about time because she is more than capable of doing much more than what she usually does.
The plot twist I really love from this episode is that Wackner seeks legal advice from Reddick Lockhart, specifically Diane. It’s weird especially coming from him but also absolutely genius given what his future plans are. He wants to expand his scope, and he will do that legally with Diane’s help. I am so here for a Patinkin/Baranski collaboration!
David Cord (Stephen Lang), a Republican, will back up Wackner with all the money he needs on this venture. I’m not sure how I feel about the guy, but there is something weird and eccentric about him.
In this episode, we meet David in the courtroom, where he is funding a client’s lawsuit against the infamous Chumhum. Section 230 was brought up, which is the law providing immunity to website platforms for third-party content (Facebook, Twitter, etc.) for any offensive material their users may post.
Liz (Audra McDonald) and Julius (Michael Boatman) join forces to argue that Section 230 is unconstitutional, mainly that it goes against the freedom of the press. I love when The Good Fight brings all these elements together!
The Good Fight Season 5, Episode 3 recap: What in the world is Carmen doing?
Carmen is a very riveting character to follow in this series, not only because she’s a newbie but because there is something I can’t quite figure out about her. Is she a villain? Is she a hero? Is she…neither?
Even Liz is confused about her, along with the other lawyers at the firm who can’t figure out why Carmen took on a client accused of rape. She definitely seems to have some game plan in mind, and now that Liz has taken Carmen under her wing, it’ll be interesting to see what happens here.
Shout-out to The Good Fight for giving us a well-composed, witty episode about something as devastating and tragic as the Capitol riot. Most shows would crash and burn while addressing this topic, but this one knows exactly how to do it.
